Drunk Driving and the Law

Driving under the influence of alcohol is a serious offence under the Motor Vehicles Act in India. If caught violators face hefty fines and even imprisonment. However there are limits to the actions traffic police can take in such cases.


What Happens if You’re Caught.?

If you are caught drunk driving

- First Offence: A fine of up to Rs 10 thousand and/or six months of imprisonment.

- Second Offence: A fine of up to Rs 15 thousand and/or two years of imprisonment.


Can the Police Seize Your Car.?

Under the Motor Vehicles Act traffic police cannot impound your vehicle solely for drunk driving. This law focuses on penalising the offender through fines and imprisonment rather than confiscating vehicles.


How Are Offenders Identified.?

When stopped for suspected drunk driving

1. Breathalyser Test: A breath analyser machine measures the alcohol level in your body.

2. Legal Limit: If the alcohol level exceeds 30 mg per 100 ml of blood, you are considered guilty of drunk driving.


Rising Cases Post New Year

Every year cases of drunk driving spike during New Year celebrations. Police frequently conduct special drives and impose heavy penalties on offenders during this period. Despite warnings many partygoers disregard the risks leading to accidents and legal consequences.
